Police powers 2
Introduction
In my assignment, I will be using my knowledge to prepare for a knowledge
check examination as a police constable. This knowledge will be based on the
duties and procedures officers have to follow to maintain the highest standards
as possible. In my first paragraph, I will be explaining the Police procedure in
granting bail and how they do it as efficiently as possible. In addition, my next
paragraph will be based on the reason that bail can be granted and why the
police have the powers to grant bail.

To begin with, let's start by describing what a bail grant is. A granted bail is
when a defendant is allowed back into the public while they await trial or
further investigations, instead of being remanded in custody. At any time they
have been arrested, a person can be released on bail. This will either be
granted in an interview at the Police station or the court after the preliminary
hearing. The discretion on bail, mainly relies on the authorities of the charge.
To grant a bail, the courts or station must abide by the guidelines set by the
The Bail act 1976. When granting a bail the court must consider the following
against the defendant; the nature or seriousness of the crime, the character of
the defendant resulting in past criminal records or associations and ties with
the community, a defendants previous record of abiding bail rules and
regulations and finally the strength of the defendants evidence.
The Police powers in line with granting bail are that when the Police custody
officer released the defendant on bail, there is usually a condition which is that
the defendant should return to the named police station, at a disclosed date or
turn up to court for the preliminary hearing. If the defendant which has been
related on bail fails to turn up to the hearing on the given date, fails to attend
the police station at specified time the police have the power to order an arrest
of the defendant for breach of bail conditions.
A custody Officer may refuse bail for the following; the defendants name or
address cannot be obtained or there is any details that the information they
have given is classes as incorrect or false. When a custody officer has refused
bail, at the soonest possible time the defendant will be taken in front of the
Magistrates court for a hearing. If the Magistrates court cannot deal with the
whole case at that specific date, then they will set out a new date for a future
hearing and then decide wether or not the defendant should or shouldn’t be
granted with bail.
Under the Criminal justice and Public order act 1994, the police have the power
to impose certain conditions when granted with bail, such as the following; The
suspect has to surrender their passport, they have to report to the police
station at regular intervals set by the custody officer and they may have to
have another person stand as surety for their surrender. The conditions that
are imposed are there to ensure the defendant follows the set rules for their
bail, they are also there to ensure a second offence isn’t committed while on
bail and that they don’t interfere with any witness during their case.
