2. STUDY UNIT SUMMARIES

Study Unit 1: Office & General Functions of the Notary

• The notary public is an admitted attorney with special duties.

• Functions include:

o Authentication of documents.

, o Drafting and attesting notarial deeds and contracts.

o Registration in the Deeds Office.

• Must act impartially, maintain confidentiality, and uphold integrity.

• Legislation: Deeds Registries Act 47 of 1937; Notaries Act.

• Ethics: High moral standard; Code of Conduct prohibits conflicts of interest.

Study Unit 2: Notarial Bonds

• A notarial bond is a written instrument registered by a notary hypothecating movable

Essential Provisions:

• Names of parties.

• Description of debt and property.
