INTERNATIONAL COURT OF JUSTICE
Introduction

The International Court of Justice (ICJ) is the principal judicial organ of the United Nations (UN). Its
primary function is to settle legal disputes between states in accordance with international law and to
provide advisory opinions on legal questions referred to it by authorized UN organs and specialized
agencies. As one of the six principal organs of the United Nations, the ICJ plays a central role in
maintaining international peace and security through lawful and peaceful means.

Established in June 1945 and commencing its work in April 1946, the ICJ succeeded the Permanent
Court of International Justice (PCIJ). All UN member states are automatically parties to the ICJ
Statute. The Court consists of 15 independent judges, no two of whom may be nationals of the same
country. Its official working languages are English and French. Despite its authority, the ICJ lacks a
formal enforcement mechanism, relying primarily on state compliance.



Establishment of the International Court of Justice

The origins of the ICJ lie in the decline of the Permanent Court of International Justice during the
1930s, which effectively ceased functioning due to the Second World War. In 1942, the United States
and the United Kingdom jointly supported the idea of re-establishing an international judicial body.

A 1944 report recommended that the new court should:

 Be based on the statute of the PCIJ

 Retain advisory jurisdiction

 Operate on voluntary acceptance of jurisdiction

 Deal strictly with judicial, not political, matters

During the Moscow Conference (1943), Allied powers recognized the necessity of an international
organization with a judicial body. Subsequently, at the San Francisco Conference (June 1945) involving
50 states, it was decided to establish an entirely new court. In April 1946, the PCIJ was formally
dissolved and replaced by the ICJ. The first case, brought by the United Kingdom against Albania, was
submitted in May 1947.



Role of the ICJ

The ICJ performs several key roles within the international legal system:

 Settles legal disputes between states peacefully

 Provides advisory opinions on legal questions

,  Promotes peaceful resolution of conflicts, reducing reliance on force

 Contributes to the development of international law through authoritative judgments

 Supports the implementation of the UN Charter, especially principles such as sovereign
equality and peaceful dispute settlement

Through these functions, the ICJ strengthens the rule of law at the international level.



Scope of the ICJ

The jurisdiction of the ICJ is limited but global in nature:

 It has jurisdiction over states only, not individuals or organizations

 Its jurisdiction is consent-based, meaning states must agree to submit disputes

 It deals with a wide range of subject-matter, including territorial disputes, treaty interpretation,
use of force, and human rights

 The Court has global reach, but

 Enforcement limitations restrict its practical effectiveness

Thus, while legally authoritative, the ICJ’s reach is constrained by state sovereignty.



ICJ Is Biased?

A major criticism of the ICJ concerns judicial bias. Empirical studies suggest that:

 Judges are more likely to vote in favor of states that appointed them

 Judges often favor states with similar economic levels (GDP per capita)

 Some evidence shows bias toward states with similar political systems

 Mild evidence exists of cultural bias (shared language or religion)

However, there is no strong evidence that judges are influenced by regional or military alliances.
Overall, while bias does not dominate ICJ decision-making, its existence raises concerns about
impartiality and legitimacy, particularly in politically sensitive cases.
