The concept of a social contract refers to an unwritten agreement between members
of a society and the state, in terms of which individuals agree to obey laws and
accept government authority in exchange for protection, order, and the promotion of
the common good. Through this agreement, citizens surrender certain personal
freedoms so that social stability and security can be maintained. The social contract
provides legitimacy to the legal system, as laws derive their authority from the
consent of the people. In a democratic society such as South Africa, the social
contract underpins the rule of law by ensuring that government power is exercised
fairly, lawfully, and in the interests of society as a whole (Letsoalo, 2019).
