Prosecutors and state advocates are both legal practitioners who represent the state
in criminal matters, but they function at different levels of the court system.
Prosecutors generally operate in lower courts, such as the Magistrates’ Courts,
where they conduct criminal prosecutions by presenting evidence against accused
persons on behalf of the state. State advocates, by contrast, usually appear in higher
courts such as the High Court and handle more serious and complex criminal cases.
They act under the authority of the National Prosecuting Authority.
State attorneys differ from both prosecutors and advocates in that they represent the
state in civil matters rather than criminal cases. They act as legal representatives for
government departments in lawsuits, contractual disputes, and claims. Attorneys, on
the other hand, are private legal practitioners who provide legal services to members
of the public. They advise clients, draft legal documents, and represent individuals or
organisations in both civil and criminal proceedings (Letsoalo, 2019).
