Discuss the general requirement that the defendant’s enrichment must have been
at the expense of the plaintiff. Refer in your answer to case law.
The requirement that the defendant’s enrichment must have been at the expense of the
plaintiff is a central element of unjustified enrichment liability in South African law. It
ensures a direct causal link between the plaintiff’s loss and the defendant’s gain. Not
every enrichment gives rise to liability. The enrichment must correspond with a
patrimonial loss suffered by the plaintiff.
In principle, this requirement means that the defendant must have received a benefit
that can be traced back to the plaintiff’s estate. The benefit may take the form of the
acquisition of property, the saving of expenses, or the discharge of a debt. At the same
time, the plaintiff must have suffered a measurable diminution in their patrimony. If
either element is missing, the enrichment action fails.
South African courts have consistently stressed that the enrichment and
impoverishment must be connected. In McCarthy Retail Ltd v Shortdistance Carriers CC
2001 (3) SA 482 (SCA), the Supreme Court of Appeal explained that enrichment liability
only arises where the defendant’s enrichment corresponds with the plaintiff’s
impoverishment. The court made it clear that enrichment is not assessed in isolation,
but in relation to the plaintiff’s loss.
The requirement does not demand that the transfer must be direct. An indirect transfer
may still satisfy the requirement, provided the link between enrichment and
impoverishment is sufficiently close. This was illustrated in Buzzard Electrical (Pty) Ltd v
158 Jan Smuts Avenue Investments (Pty) Ltd 1996 (4) SA 19 (A). In that case, a
subcontractor improved property owned by the defendant but had contracted with a
third party. The court accepted that the owner’s enrichment occurred at the expense of
the subcontractor because the latter had incurred expenses without compensation,
while the owner benefited from the improvements.
