Question 1
(a) Briefly discuss the differences between Civil Law and Criminal
Law.
Learning Unit 1: The Function of Law.
The law serves the important function of creating and maintaining peace
and order in society. Within this function, two important branches of law
operate, namely criminal law and civil law.
Criminal law applies when a person engages in conduct that disturbs public
peace and harmony in society (Learning Unit 1). Such conduct is regarded
as a crime. The state, acting on behalf of society, prosecutes the wrongdoer
in a criminal court. If the accused is found guilty, the court imposes a
criminal sanction such as imprisonment, a fine, correctional supervision or
community service (Learning Unit 1).
The purpose of criminal law is therefore to punish wrongdoing and
protect society as a whole.
