ASSIGNMENT QUESTION
Drumroll Association (DA) is a trade union established to protect the rights of musicians
in South Africa. DA has invited you, a labour law student at UNISA, to give a
presentation at its office-bearers’ workshop.
Your invitation expressly stated that you should prepare a talk on collective
labour law topics. As part of your presentation, discuss the extent to which South
African law protects the right to freedom of association.
In terms of section 18 of the Constitution of the Republic of South Africa, 1996,
everyone has the right to freedom of association. This means that all persons have the
right to associate with others to promote and protect their common interests. In the
employment context, this right is further strengthened by section 23 of the Constitution,
which specifically protects labour rights.
