, How did Florida response to the medical malpractice issue discussed in the 2nd video? Explain
the two requirements of the Comprehensive Medical Malpractice Reform Act. - ANS Florida
responded to the medical malpractice crisis through reforms and legislative changes. The first
was the 1985 Comprehensive Medical Malpractice Reform Act, which added steps that must be
taken before filing a malpractice lawsuit. The first requirement is that you must provide notice
of intent to the person/practice you are suing. The second is you much engage in pre-suit
discovery. Pre-suit discovery encourages parties to settle before going to court over a 90-day
period. It allows the practice to conduct their own investigation in order to decide whether they
should settle or take it to trial.



The second response is the 2003 Medical Malpractice legislative changes, which put caps on
non-economic damages, caps on damages in the emergency room, and narrowed who is
considered an "expert." The non-economic damages cap was overturned in 2017 by the
Supreme Court.



Florida was bifurcated because the state's loss rate was so high. What does bifurcate mean and
what did Florida do? - ANS To bifurcate means to break into two branches. In this case,
Florida had to be broken up into a higher and a lower portion. The higher one includes places
more south, such as Miami. The lower one includes places such as Gainesville and the
panhandle. In an attempt to lower this loss rate, Florida responded by increasing premium
rates. So far, this response has been rather unsuccessful.



Explain each of the four elements of the medical malpractice. - ANS The four elements of
medical malpractice are DUTY, BREACH, CAUSATION, AND DAMAGES. You need all four of these
elements in order for there to be negligence. Duty is essentially your responsibility as a provider
to your patient. An example of this would be a physical therapist having the duty to provide
physical therapy to a patient. Breach is a breach in duty, or some type of mistake. Take a physical
therapist who is providing therapy to a patient when their hip pops out of place. The breach has
to cause an injury (Causation), and the injury has to cause damages (Damages). You need to
have some type of monetary compensation in order for the patient to get a new hip. All of these
things come together to indicate Negligence.
