1. Does the distribution of building materials amount to administrative
action?
To determine whether the distribution of building materials by the
Department of Human Settlements amounts to administrative action, we
must apply the definition in section 1 of the Promotion of Administrative
Justice Act 3 of 2000 (PAJA) and section 33 of the Constitution.
(a) Is there a “decision” taken?
PAJA defines administrative action as a decision or failure to take a
decision.
In this case, the Department decided to distribute building materials to the
affected residents.
Therefore, a decision exists.
