1. The offences were allegedly committed in Cape Town. However, A was arrested in
Pretoria. Due to the nature and seriousness of the alleged offences, the National
Director of Public Prosecutions (NDPP) decides that A should first appear in the
Supreme Court of Appeal (SCA), where the trial will also be conducted.
Critically discuss the efficacy of this decision. (5)
ANSWER:
The NDPP’s decision for A to first appear in the Supreme Court of Appeal (SCA) raises
both legal and practical concerns. Ordinarily, criminal trials commence in the court within
the jurisdiction where the offence occurred, in this case, Cape Town (Burchell 2021).
The SCA primarily serves as an appellate court and is not a court of first instance, so
directing A to appear there initially may conflict with procedural norms (Criminal
Procedure Act 51 of 1977, s 166).
The NDPP might justify this on the basis of the seriousness and national importance of
the offences, aiming to centralize proceedings and ensure expert judicial oversight
(Burchell 2021). However, this approach could impose logistical burdens on the
accused and witnesses, and may invite challenges to the court’s jurisdiction
