Constitutionalism represents far more than the mere existence of a written constitutional document. It
embodies a comprehensive philosophy and practice of governance wherein state authority is exercised
within carefully defined legal boundaries, subject to robust mechanisms of checks and accountability, and
committed to the protection of individual rights and democratic values. While many nations possess
constitutions, constitutionalism—the philosophy and culture of limited government—remains a distinctive
achievement that separates functioning democracies from authoritarian systems that merely use
constitutional documents as facades for unchecked power. Constitutionalism asks a fundamental question:
How can governmental power be reconciled with individual liberty? The answer lies not in formal
constitutional texts alone, but in the lived experience of constitutional values, institutional independence,
and the genuine commitment of both state and citizens to constitutional principles.

Defining Constitutionalism: Conceptual Foundations

Constitutionalism refers to the philosophy, practice, and culture of limited government, wherein state
authority is exercised within legal boundaries and subject to checks, accountability, and rights protection.
This definition, while concise, contains within it several layers of meaning that deserve unpacking.
Contemporary constitutional scholars have refined this understanding through various formulations. Babie
and Bhanu (2022) characterize constitutionalism as the framework "balancing governmental power with the
rights of individuals," ensuring that the State does not destroy the very values it exists to promote. This
formulation captures the essential tension that constitutionalism seeks to resolve: how to create a state
powerful enough to maintain order and provide public goods, yet restrained enough to respect individual
autonomy and protect minority rights.

Ruzela Da Cruz (2022) emphasizes that constitutionalism imposes "necessary limitations on government
power" to prevent abuse and protect rights. This focus on limitations reflects a historical truth—
constitutionalism emerged as a response to absolutism and arbitrary rule. Monarchs who claimed unlimited
authority provoked the development of constitutional thought as a means of constraining their power. Even
in modern democracies, the constitutional impulse remains essentially protective: it recognizes that power,
however democratically derived, requires restraint.

Perhaps most significantly, Maru Bazezew (2009) articulates a crucial insight: having a constitution alone is
insufficient; constitutionalism demands legitimacy, accountability, rule of law, and restrictions on arbitrary
power. This observation distinguishes between constitution and constitutionalism in a way that proves
illuminating. A state may possess a constitution without practicing constitutionalism—it may have a written

, document that is routinely violated by those in power, or that grants powers which are arbitrarily exercised.
Conversely, constitutionalism cannot exist without the reality of limitations on power. The core principle
thus emerges clearly: a state may have a constitution without constitutionalism, but never
constitutionalism without limitation on power.

Essential Features of Constitutionalism

Constitutionalism rests upon several interconnected features that collectively create a system of limited,
accountable government. Understanding these features reveals how constitutionalism operates as both a
structural and cultural phenomenon.

Limited Government forms the foundational feature. Government must operate within constitutionally
allocated powers; it cannot transcend the boundaries established in the constitutional document. This
principle creates what might be called a "constitutional ceiling"—powers beyond this ceiling are simply
unavailable to government, regardless of how pressing the need or how noble the intention. In practice,
limited government means that no branch of government possesses unlimited authority, and that attempts to
exercise powers beyond constitutional allocation face legal resistance and judicial invalidation.

Rule of Law ensures that no one stands above the law, and that laws themselves must be fair, predictable,
and non-arbitrary. The Rule of Law principle, discussed extensively elsewhere, fundamentally supports
constitutionalism by requiring that even limited governmental powers be exercised according to established
legal procedures and standards. Without the Rule of Law, constitutionalism becomes merely aspirational—
the constitution might limit governmental power in theory, but that limitation remains ineffective if the law
itself can be applied arbitrarily.

Separation of Powers divides governmental authority among distinct institutional actors—legislature,
executive, and judiciary—and supports this division through systems of checks and balances. The rationale
is straightforward: concentrated power invites tyranny, while distributed power creates mutual restraint.
Each branch possesses the capacity to obstruct the others, creating a dynamic of interdependence that
prevents any single institution from becoming overwhelmingly dominant. This institutional pluralism proves
crucial to constitutionalism because it ensures that no single will, however powerful, can unilaterally
determine policy.

Judicial Review emerges as perhaps the most distinctive institutional feature of modern constitutionalism.
Courts possess the power to scrutinize governmental action—both legislative and executive—against
constitutional standards, and to invalidate measures that violate the constitution. This power represents a
revolutionary development in political theory, as it grants unelected judges authority over democratically
chosen representatives. Yet judicial review proves essential to constitutionalism precisely because it provides
an institutional mechanism for maintaining constitutional supremacy. Without judicial review, the
constitution becomes merely advisory, and those in power can ignore constitutional limitations with relative
impunity.
