An antenuptial contract is a written agreement concluded by two parties before the
marriage is solemnised in order to regulate the matrimonial property system of their
marriage. The contract is executed before a notary public and must be registered in
the deeds registry within three months after its execution to be enforceable against
third parties. The main purpose of an antenuptial contract is to exclude the automatic
system of community of property and community of profit and loss that would
otherwise apply to the marriage. Through this contract, the parties determine how
their assets and liabilities will be managed during the marriage and how they will be
divided if the marriage ends.1
A postnuptial contract, on the other hand, refers to a matrimonial property agreement
that is executed after the marriage has already taken place. This situation usually
arises where the parties intended to marry out of community of property but failed to
execute and register an antenuptial contract before the marriage. Because the
matrimonial property system automatically becomes community of property when no
antenuptial contract exists, the spouses must apply to the High Court for permission
to execute and register a postnuptial contract. The court will only grant such an order
if certain requirements are satisfied, including proof that the spouses had originally
agreed to marry out of community of property and that the rights of creditors will not
be prejudiced.2
The main difference between these two contracts therefore lies in the time at which
they are concluded and registered. An antenuptial contract is concluded before the
marriage, while a postnuptial contract is executed after the marriage with the
permission of the court. In addition, an antenuptial contract becomes effective once
