Factual Background
Hennie is a 25-year-old, Afrikaans-speaking farm owner from the Free State who does not fully
understand English. He approached Bantu Bank for credit to purchase a bakkie for work and
farming purposes. The Bank conducted a credit assessment, but the contract was in English
only a language Hennie did not understand. Despite having information con
rming Hennie's
lack of comprehension, Bantu Bank proceeded to conclude the credit agreement with him. After
six months of repayments, Hennie defaulted. Bantu Bank has since instituted civil proceedings
against him. Hennie now seeks legal advice.
