While reading the study units, focus on the nature of the different rights that are dealt with in this module, namely personal rights, real rights and limited real rights (Study Unit 2). Keep in mind that ownership is the most complete real right that a person can have regarding his or her own thing, but the law and the rights of others can limit this right (Study Unit 3). Real rights such as ownership and limited real rights like servitudes, should be registered in the Deeds Registry, while personal rights are usually not registered. Ownership can be acquired in different ways, either through original means or through derivative means (Study Units 4 and 5). Certain remedies exist to protect the rights and interests of persons (Study Unit 6). Different real relationships are distinguished and discussed in Study Unit 8. Against this background, consider the following set of facts: Thandi owns a hotel called “Imbizo Lodge” in Durban. She bought three new fridges for the kitchen from Value Save Traders (Pty) Ltd, in terms of a credit agreement. ValueSave Traders (Pty) Ltd reserves ownership of the fridges until the final instalment has been paid. Thandi also owes First Metro Bank R500 000. The debt is secured by a mortgage bond registered over the hotel. A guest of the hotel, Annie, accidentally packed a towel that looked like her own into her suitcase, honestly believing that it was hers, before leaving the hotel. One of the hotel’s chefs, Sipho, asked Thandi whether he could rent one of the small rooms in the hotel for a period of six months. Thandi agreed, and they concluded a lease agreement. Sipho also asked Thandi to borrow R5 000. They agreed that Sipho would pledge his cell phone as security for the loan. Thandi paid the R5 000 into Sipho’s bank account, but both parties agreed that it would not make sense for Sipho to hand the cell phone to Thandi. Thandi stated that she 5 trusted Sipho and believed that he would repay the money. A serious dispute later arose between Thandi and Sipho, and their relationship deteriorated. Sipho took a few days’ leave. While Sipho was away, Thandi changed the lock of Sipho’s room, removed his belongings and placed them in a storeroom. When Sipho returned, he discovered he could not access his room. He became extremely angry and set Thandi’s car on fire. He then broke into the storeroom and the room he had rented from Thandi, damaging the locks and doors of both rooms in the process. Sipho also kicked one of the fridges Thandi had purchased from Value Save Traders (Pty) Ltd, damaging it severely. Thandi contacted the private security company responsible for the hotel's security. Sipho later approached his friend, Daniel, a law student, for advice. Daniel advised Sipho to institute rei vindicatio against Thandi to recover his belongings and the control he previously exercised over the rented room. Sipho is a lawful holder of the room he rented from Thandi. In terms of the lease
agreement, Sipho had lawful physical control over the rented room, while Thandi
remained the owner of the property. Sipho therefore exercised lawful holdership over
the rented room based on the lease agreement (Scott, Property Law Study Guide 28).




Question 2

Annie is a bona fide possessor of the towel. She had physical control over the towel
and honestly believed that the towel belonged to her. The mental element is therefore
good faith (bona fides) because she mistakenly believed she was the owner of the
towel (Scott, Property Law Study Guide 22).




Question 3

If Annie had stolen the towel, she would be a mala fide possessor. Although she
would still have physical control of the towel, the mental element would be bad faith,
since she would know that the towel belongs to someone else but intentionally took it
(Scott, Property Law Study Guide 22).
