Service Delivery Responsibilities of Giyani Local Municipality During Flood
Disaster
Introduction
Local government in South Africa plays a critical role in ensuring the delivery of basic
services and responding effectively to disasters that affect communities. The floods that
occurred in Giyani in Limpopo in January 2026 caused extensive damage to homes,
infrastructure, and agricultural land, disrupting the daily lives of residents. The death of
a young child, destruction of property, and the inability of residents to access essential
services demonstrate the seriousness of the disaster. In such situations, the Giyani
Local Municipal Council must act within the framework of national legislation governing
local government and disaster management. This assignment analyses the service
delivery responsibilities of the municipality and explains how relevant national legislation
applies to the situation.
Constitutional Mandate of Local Government
The Constitution of the Republic of South Africa, 1996 establishes the foundation for
local government responsibilities. Section 152 outlines the objectives of local
government, which include providing democratic and accountable government, ensuring
the provision of services to communities in a sustainable manner, promoting social and
economic development, and ensuring a safe and healthy environment.¹
In the case of the Giyani floods, the municipality has a constitutional duty to respond to
the disaster by ensuring that affected residents receive essential services such as
water, sanitation, shelter, and access to emergency support. Local government must
also ensure that public safety is protected and that necessary measures are taken to
restore normal living conditions.
