LCP4804 Assignment 4 (COMPLETE ANSWERS) Semester 1 2026 - DUE 1 April 2026
LCP4804 Assignment 4 (COMPLETE ANSWERS) Semester 1 2026 - DUE 1 April 2026. ... Before his death Abel married his wife Beauty by customary law. After Abel's death Beauty went to register their customary marriage at the Home Affairs Department, only to be told, to her shock, that Pumla had already been to that office to register hers with the deceased. Beauty knew that Pumla did what she did in order to claim Abel's estate. 1.1. Comment on whether Abel could possibly have had two valid customary marriages, referring to any law/legislation recognising it. (20) 1.2. What would your comment be if Beauty says Abel never told her about his customary marriage with Pumla and that Beauty and Abel subscribed to Tsonga customary law which does not recognise Abel's further customary marriage, contracted without her consent as Abel's senior wife. (20) 1.3. What would be the position if Khumu, being Abel's father, says he does not recognise both Beauty and Pumla as his son's (Abel's) widows as he never negotiated these marriages. (20) 1.4. Would Beauty's and Pumla's situation be any different if Khumu's issue with their customary marriages was their invalidity for no-observance of the necessary imvume/ukumekeza traditions. (20) 1.5. What would be the position if Qunu appeared claiming to be the only descendant of Abel by an earlier relationship. Qunu discredits Beauty’s customary marriage because her lobolo was never paid in full; and Pumla's one because she was never delivered to the groom's family. (20)
