South Africa is a country with many different cultures. One of the cultural
practices linked to marriage is known as ukuthwala. South African law
recognises and respects cultural practices, but at the same time the law
has a duty to protect people from harm, especially women and children.
The

Constitution of South Africa of 1996 protects important rights such as
human dignity, equality, and the right to be free from violence and harm
(section 7(1) of the Constitution of 1996).

In their 2021 article titled “Should South Africa Criminalise Ukuthwala
Leading to Forced
Marriages and Child Marriages?” by L Mwambene and RH Mqidlana, the
practice of ukuthwala is discussed.
