RE: Lawfulness of Tebogo Mokoena’s Indefinite Suspension

1. FACTS
Tebogo Mokoena, a Grade 11 learner at Thuto-Lesedi Secondary School, was found in
possession of cannabis on school premises on 10 March 2026. The principal suspended
Tebogo indefinitely pending a formal disciplinary hearing. No written notice of the
suspension was given to the learner or his parents. The parents have now approached
the Legal Aid Clinic seeking advice on whether the suspension is lawful.
2. LEGAL QUESTION
Whether the indefinite suspension of Tebogo Mokoena, without written notice or
observance of procedural fairness, is lawful in terms of applicable South African
education law.
