Delegated Legislation.
Introduction: Law made by virtue of powers conferred by acts of
parliament.
This will come from the enabling act, a ‘parent’ act.
Different types of Delegated Legislation:
- Orders in council
- Statutory instruments
- By laws
The power comes from the privy council, and will always need
royal assent. Generally these are executed in times of
emergency/national importance.
Allows government to bypass parliament to create law, such as:
- Transferring power between govt departments
- Bringing into effect AoP’s- Misuse of drugs act
- Giving effect to EU Legislation.
