1. Problem Statement
South Africa has one of the highest rates of sexual violence in the world, with a significant
proportion of cases involving repeat offenders who operate across multiple jurisdictions (Jewkes et
al., 2009). Serial rape—defined as the commission of two or more rape offences by the same
individual or group with a cooling-off period between incidents—poses unique investigative
challenges due to the geographical dispersion of crimes and the absence of immediate suspect-victim
relationships (Police, 2016). DNA profiling, particularly through the National Forensic DNA
Database (NFDD), has been lauded as a gold standard forensic tool capable of linking serial cases,
identifying recidivists, and exonerating the innocent (Lynch, 2003).
However, despite legislative advancements such as the Criminal Law (Forensic Procedures)
Amendment Act of 2013, the practical efficacy of DNA profiling in South African serial rape
investigations remains questionable. Chronic backlogs at forensic laboratories, poor crime scene
management, delays in DNA analysis, under-resourcing of the SAPS Forensic Science Division, and
low rates of evidence collection from victims have all undermined the potential of DNA technology
(Pepper, 2014; Gqamana, 2018). Moreover, legal and ethical concerns regarding sample retention,
consent, and database oversight further complicate its application. Consequently, the extent to which
DNA profiling actually contributes to solving serial rape cases, securing convictions, and preventing
future offences is not well understood. This problem necessitates a critical analysis of the gap
between the theoretical promise of DNA profiling and its operational reality in the South African
criminal justice system.
