(a) Nature and characteristics of law
Question: Which statement BEST describes the distinguishing characteristic of law
compared to other normative systems such as religion or morality?
Answer: Correct answer: Law is enforced by state organs and its violation
carries legal consequences.
• Law is a set of rules of conduct that governs human behaviour, is binding on all
persons in society, and is enforced by the state.
• Other normative systems (religion, individual morality, community mores) also guide
behaviour but are not enforced through state machinery.
• The key distinguishing feature is state enforcement: ignoring the law may lead to
prosecution, punishment, or an order to compensate another party.
• Law must also be general (applying to all), certain (predictable), effective, and
just.
Key Concept
The law governs human conduct and should be obeyed by all. Unlike religion
or morality, non-compliance is enforced through state institutions such as the
police and courts.
(b) Divisions of law
Question: Identify the TWO main divisions of South African law and briefly explain the
difference between them.
Answer: 1. Public Law – regulates the relationship between the state and individu-
als (or between state organs). Includes constitutional law, administrative law, criminal
law, and tax law.
2. Private Law – regulates relationships between individuals (or legal persons).
Includes contract law, delict (tort), family law, and property law.
