Amo has a right of co-ownership (co-ownership in undivided shares) over the
Groenkloof property together with Kai. Ownership is the most complete real right a
person can have over property and entitles the owner to use, enjoy and dispose of the
property within the limits of the law. Since the property is registered in both their names,
Amo and Kai are co-owners and each has an undivided share in the property. (Mostert

Amo and Kai are incorrect in believing that ownership allows them to use the property
as they please. Ownership in South African law is not absolute and may be limited by
legislation and the Constitution. Municipal zoning regulations lawfully restrict how land
may be used in the public interest. Since the property is zoned for residential purposes
only, the municipality may prohibit the operation of a restaurant on the premises.
