Dear Ms de Búrca,
Re: Recognition of Professional qualifications
I write in relation to the above matter and further to our meeting at our Soho
Law office on 14th December 2023 during which you instructed me in relation
to your concerns about your legal position as to your professional qualifications
being recognised in Malta.
I understand from your instructions, along with the paper work that you have
subsequently provided me with, that it is your desire to potentially live and work
in Malta where your retired parents currently reside. I also understand you are
aware of your right to live and work in Malta as an Irish citizen, which preserves
your right to return to the UK or Ireland if you want to.
I am instructed that your main concern is whether your professional teaching
qualifications, namely your Bachelor’s Degree in English Literature, your
Postgraduate Certificate of Education (PGCE) and your Qualified Teacher
Status (QTS)) obtained in the UK between 2014 and 2018 will be valid and
recognised in Malta when you arrive there to seek employment as a teacher.
Additionally, I understand your concerns to be driven by your qualifications
might not be recognised in Malta now that the UK has left the European Union.
I also understand that you are not particularly concerned about you rfluency in
the Maltese language.
I have now been able to review your case and inform that I have carried out
comprehensive research including research: (i) on the law as an EU citizen (ii)
the Malta Education Act (iii) the EU directives (iv) opinion documents (v) case
law (vi) journal articles (vii) EU textbooks (viii) jobsites, Expat blogs on teachers
with similar experiences and immigration websites. Further, I researched
remedies available and alternative options available to you so as to allow you
to seek out employment. I am instructed that whilst you have both Irish and UK
