Description of Workplace
The workplace is a construction project involving the construction of 2 units of detached
house and 12 units of semi-detached house within a plot of land that is 39,063 square feet
in size. At the time of accident, the construction had begun to construct access for the
piling machines to enter the site. Excavators were used to level the ground at the
entrance, located on the north side of the site, with gravel and hardcore that was delivered
to the site. On the southern end of the site, a group of workers were tasked to construct
scaffolding for the purpose of constructing noise barrier that will surround the whole
project site.
Description of Accident
On the day of the accident, the injured was assigned to assist the scaffolders by passing
the scaffold materials from the ground. While the construction was ongoing, the
scaffolders realized there was not enough scaffold clips and instructed the injured to get
them from the site store beside the entrance of the project site. The injured was walking
to the store, he realized that the access was blocked by the excavator which was working
on levelling the ground. As the injured, who was behind the excavator, tried to walk pass
the excavator, it moved and, in the process, shifted the steel plate beneath it. The steel
plate hit the injured’s right foot and he collapsed to the ground. On hearing the cries of
the injured, the banksman, who was standing in front of the excavator, signaled for the
excavator to stop moving and went behind to investigate and found the injured. The
