Unit VI Proposal
In our company it has been brought to the attention in the human resources department
that employees are utilizing their work e-mail seeking support for union representation. We have
received pamphlets that were distributed in various areas of the facility and parking lot; detailing
workers’ rights and suggesting that voting in a union will increase pay and benefits. In this
proposal I will answer the company’s management question on if a union has the right to contact
workers through their work e-mail addresses and distribute pamphlets on company property. I
will provide advice and guidance on how to respond to these tactics and the union’s message on
enhancing worker’s pay and benefits.
Company Guidance
My guidance to the company as a human resource representative is some of these actions
are protected by the National Labor Relations Act. Employees are covered by the National
Labor Relations Act, they have the right to attempt to form a union where none currently exists
(NLRB, 2021). The utilization of work e-mail and passing out pamphlets is allowed under the
National Labor Relations Act; however, it must be done on certain times in specific areas.
The first action that needs to happen within the company is training of supervisors and
managers over the National Labor Relations Act and union rights. This training will be
conducted by company resource representatives. The importance of this training is to ensure that
supervisors and managers are educated enough with the law to prevent a potential lawsuit against
the company for denying employee rights with unions. It is not intended to make them subject
matter experts, but knowledgeable enough to know what is right or wrong or whom to ask.
