Five Actions to take after Review of the Citation and Notification of Penalty Letter

When OSHA inspects a workplace, they usually present the employer with a citation and

penalty notification to show how the workplace violates the Occupational Safety and Health Act

(1970). Based on the letter that I received from Smith (2015), I would undertake several actions

to either protest or accept the citations and penalties.

After reviewing the letter of citation and penalty notification, the first action that I would

take is to contact the OSHA commission to present my protest to the abatement fees, citation,

and penalties presented in the letter within fifteen working days. The reason behind this action is

because, according to the OSHA Act, citations are regarded as a violation only when an

employer fails to contest or if it is affirmed by the court or review commission. To conduct this

action, I will need to mail a contest notice to the United States Labor Department.

The second action is to post a copy of the penalty notification and citation in a visible

location at my workplace where the violation occurred. This posting will remain until the

violations in the letter are abated. However, before posting, I will ensure that I have blacked out

the area that bears the penalty fees for confidentiality purposes. This action is important in

informing the employees and all stakeholders of the hazards they are likely to face at this

location. The action is a requirement from OSHA, and skipping it is punishable. Also, this action

will empower employees that wish to take further action based on the citation and penalties.

When employees and other stakeholders are aware of the citation, it means that they are

implicitly giving consent to continue working within the workplace. A copy of the citation and

notification of penalty letter will be made for posting to carry out this action.

The third action that I will take is calling for an informal conference through the OSHA
