RUNNING HEAD: EMTALA SCENARIO ANALYSIS 1 EMTALA Scenario Analysis EMTALA SCENARIO ANALYSIS 2 The Emergency Medical Treatment and Labor Act was enacted in 1986 with the main aim being to ensure that Americans got emergency health when they needed it. The act specifies that the hospitals should provide the treatment regardless of the recipient’s ability to pay. It specified that the Act only applied to participating hospitals. Participating facilities are described as those that receive funds from Centers for Medicare and Medicaid Services and the Department of Health and Social Services (Furrow et al, 2015). Any person, regardless of his or her legal status, citizenship or ability to pay can get emergency treatment from almost any hospital since many facilities fit the Act’s description. In this case, the head physician at the facility does not seem to agree that the situation fits under the Act’s description. Understanding the situation requires that one understands the various aspects. The analysis will show there is no reason why the patient should not be transferred. Issues The first requirement is that the situation has to be a medical emergency. That means that one cannot request a transfer for a run of the mill illness under the act. Medical emergencies have at the very top life-threatening conditions. That means that if a physician feels that a problem has the potential to be fatal, he or she can use the provisions of the act.
