With reference to this Act, answer the following questions: 1.1 Read both the preamble and long title of this Act and summarize what you consider to be the purpose of the Legal Practice Act 28 of 2014. You may need to refer to item 12.2.12 in Learning Unit 2 of your study guide. (4) Answer The purpose of the Legal Practice Act 28 0f 2014 is to regulate the legal profession and ensure that the values supporting the Constitution are embraced and that the rule of law are upheld, by means of a single statute. The Act regulates the affairs of legal practitioners and provides for the admission and enrolment of legal practitioners but also regulates the professional conduct of legal practitioners so as to ensure accountable conduct by providing for the establishment, powers and functions of a National Forum on the Legal Profession. 1.2 What is a “legal practitioner”? Explain how this concept in relation to the work done by “attorneys” and “advocates” Answer A legal practitioner is a person who practises law. Legal practitioners spend their time solving complex problems and making appropriate decisions. Being a legal practitioner means that you must have the ability and skills to resolve different kinds of problems, especially legal problems. In addition, they must have the ability to apply the relevant legal rules and principles together with innovative and critical thinking to arrive at a legally sound and appropriate solution to a problem.
