MRL3702_ Labour Law_ SEMESTER 02 ASSIGNMENT 02. MRL3702 - Labour Law. Collective bargaining is were trade unions representing employees engage with employers or employer organisations in order that they find common ground through listening to each different perspective on issues of common interest . Though there is no express duty to engage in collective bargaining for the employer the failure to bargain can result in industrial action such as strikes as per section 64(2) of the labour relations Act , hereafter referred to as LRA 1 Concepts such as Ubuntu encourage resolution of differences through respectful engagement in order to reach a workable compromise. The LRA encourages collective bargaining by regulating the formation of Unions and regulating the establishment of bargaining institutions. A single employee cannot bargain on their own behalf but should do so through trade unions. Those hesitant employees of Agro (Pty) Ltd would find it to their benefit to join their trade union which would become their bargaining agent .Employer can bargain with a trade union directly or through employer organisations that will act as their bargaining agent. Collective bargaining can occur at the following levels in the context of Agricultural equipment manufacturers Industry a. Plant level bargaining occurs between employees of Agro (Pty ) Ltd and their employer b. Sector Level bargaining would take place in relation to the Agricultural manufacturing sector in Pretoria c. Industry level bargaining would take place for the whole industry of Agricultural equipment manufacturing in the country 2 Collective bargaining can occur in bargaining councils that are established by one or more registered trade unions and one or more registered employer’s organisations in the Agricultural manufacturing industry. In the event that there is no bargaining council a statutory council can be established upon application to the registrar. A bargaining councils is analogous to a Kgoro where parties meet to discuss different issues.
