LCP4801_MARKED_ASSIGNMENT Article 46A bis, of the Malabo Protocol, provides that ‘no charges shall be commenced or continued before the court against any serving African Union Head of State or Government, or anybody acting or entitled to act in such a capacity, or other senior state officials based on their functions, during their tenure in office’.1 Therefore providing immunity for sitting heads of state and senior state officials of the African Union, however, this immunity is not absolute as it is only for the duration of tenure in office, thereafter the case may be tried.
