C841: Issues in Information Security Task 1 – Legal Analysis C841: Issues in Information Security – Task 1 2 A.1. TechFite’s Applications Division has allegedly been conducting unethical and illegal business practices. The laws applicable to the activities TechFite’s Applications Division have been involved in are the Computer Fraud and Abuse Act and the Electronic Communications Privacy Act. The Computer Fraud and Abuse Act (CFAA) is defined by 18 USC 1030: Fraud and related activity in connection with computers. The Electronic Communications Privacy Act (ECPA) is defined by 18 USC 2511: Interception and disclosure of wire, oral, or electronic communications prohibited. Under 18 USC 1030 definition, the computers used by employees under the Business Intelligence (BI) Unit for TechFite’s Applications Division are classified as “protected computers” due to TechFite business being primarily conducted through the internet, thus conducting business across state lines. The employees who accessed these computers did so through former employees’ accounts which enabled them to gain unauthorized access with escalated privileges on the above-mentioned computers. Because the employees gained unauthorized, privileged access to protected computers, they were in direct violation of the CFAA. Sarah Miller, who is the senior analyst for the BI Unit, was found to have been scanning other companies’ networks. Network scanning is typically done in order to gain information about a network’s vulnerabilities, open ports, and IP address of connected devices. This information in turn can be used to conduct attacks in order to gain unauthorized access to information such as emails, documents, databases, etc. Along with Sarah Miller’s activities, Jack Hudson was also found to have been coordinating intelligence gathering through mining companies’ trash.
