Pvl2601 assignment 1 Nothando Dube Question 1 1. Mr and Mrs Sisulu entered into a civil marriage subject to the accrual system ten years ago. Mrs Sisulu resigned from her job as a teacher after the Sisulus’ only child, Lerato, was born. Lerato lives with severe physical and mental disabilities and requires constant care, Mr Sisulu discovered that his wife was having an affair on him then he instructed his wife ( Mrs Sisulu) to leave the house. It is stated that during substance of civil marriage both spouses are entitled to live in the matrimonial home and use house hold assets, irrespectively of being married in or out of community of property. It doesn’t matter whether the spouse that is ejecting another is the owner or the one that is paying rent or bills in the house , marital guily and children’s interest plays a big role when it comes to ejecting a spouse at the matrimonial home. The Sisulu’s were in a civil marriage in terms of the accrual system. The accrual system is based on the total separation of the marital property. It is contended that marriages that are conducted in terms of the accrual system, tend to be unfavorable to the party or spouse who is unemployed for the duration of the marriage. Based on the facts of this case, Mrs Sisulu left her employment to focus on the well being of Lerato. Currently in view of the circumstances should the marriage be dissolved by divorce, Mrs Sisulu will find herself in a precarious financial
