RAPE, A “BIG DEAL” 1 HSM 410 Week 7 Final Course Paper, Rape - A Big Deal (Emergency contraception) Rape, A “Big Deal” HSM 410 Rape, A “Big Deal” Imagine yourself being a youn g woman just going about your day. Your friend Amy calls you & tells you of a party that her friend is having tonight. Amy wants you to go with her, & you gladly accept. You arrive at the party & you notice an attractive guy having a conversation with some people you know. They introduce the two of you to each other, & you hit it off. After a few hours you decide you want to go home, as it’s getting late, & he asks if he can walk you home. You agree & the two of you leave together. As you arrive at your apartment door, he asks if he can come in, you tell him another time would be better. But he won’t take no for an answer. He forces his way in & has his way with you. Once finished heruns quickly out of the apartment & leaves you full of fear & raped. It’s unfortunate that raped stories such as this happen. & these women need all the help they can get once these violent, sexual acts have occurred. Which leads up to wht the article & court case are talking about. There is always going to be an argument between church & state, & that’s no different when it relates to Catholic hospitals. As the articl shows, many Catholic hospitals “have no emergency contraceptive restrictions… the treatment is a “big deal” or a “big issue” & that even though it is provided, the hospitals“don’t like it” (Smugar, 2000, p.1374). So even though in some Catholic hospitals theydon’t prohibit the use of emergency contraceptives, at the same time they aren’t promoing it either. & this is where the ethical side of things comes into play. When it comes o research done for the article, you can clearly see that the Catholic hospitals are against woman taking the contraceptives. Some don’t even want it to be discussed between the physician & rape victim. I think this is where the Catholic hospitals are ethically wrong. The ethical considerations that are of this issue would be if a physician should go against policy & make the decision to discuss or even prescribe emergency contraceptives to the rape victim. While the Catholic hospital themselves have policies in place saying that you should only talk to them about it if the rape victim brings it up, I think this is ethically wrong. First of all, you can only imagine what can be going on in the victim’s mind after having to live through such a dramatic experience. It’s up to the physician to do everything they can to help out the rape victim in their time of need. At the very least they need to discuss with the victim about there options as there is so little time to act (within 72 hours). As for the legal side of this matter, as a woman you should have the legal right to the emergency contraceptives regardless of what hospital she is in. What if the next hospital isn’t for 50 miles? She needs proper care & regardless of if it’s a Catholic hospital or not she should be able to receive the care that she deserves. If she asks for a prescription for the emergency contraceptives, she shuld be able to receive them right then & there. Or at least be prescribed the emergency contraceptves & be able to get it from the hospital’s pharmacy without any trouble. I understand that there re policies in place, but when they are ethically wrong & in the court case legally wrong, it shoud be overlooked. If I were a judge in the Brownfield v. Daniel Freeman Marina Hospital case, I would have to agree with theother judge’s decisions. I for one believe that a patient should always be given all the information they need to make a conscience decision, this includes to rape victims. That information is th hospital’s responsibility to give to the rape victims & let themknow that there are contraceptivs that can be taken in order to prevent a pregnancy. & the key word in this is prevent, so you aren’t taking away a life like you would in an abortion, you are just preventing yourself from getting pregnant. & this is why it needs to hppen within the 72 hours of the unfortunate incident. By the hospital not giving the iformation to the rape victim, not only were they legally wrong, but ethically as well. References Smugar, S., Spina, B., & Merz, J. 2000, September). Informed Consent for Emergency Contraception: Variability in Hospital Care of Rape Victims. American Journal of Public Health, 90(9), . Retrieved December 6, 2012, from Academic Search Premier database. Week 1 Discussion Question 1, What is Healthcare Policy What exactly is Health Care Policy? Who does it affect? I think healthcare policies can affect everyone as far patient, doctor, staff & etc. however I have worked for a couple different office settings & I have to say their policies were quite different so I think its determined by who runs the medical practice & what kind of practice is being ran. For instance I worked for a family practice where the mother was the office manger & all the policies that were in place went for every doctor on staff except the 3 that was her kids. I thought that was worst office setting ever until I worked for a chiropractor who led me to do research on other wellness clinics of the same aspect & came to the conclusion I never want to do billing or really any service for them. I think whatever policies are in place should be consistent & there to make your business or practice healthy & safe for all involved but I must say from experience all practices are not ran in that fashion . Public Policy I believe to be just a system of laws governed by maybe a board of directors or whoever may be over a company haven’t really finish reading how that plays directly into the medical field as of yet. Healthcare policy are the rules, regulation & guidelines that exist to operate, finance & shape healthcare delivery. Healthcare policy covers a range of health related issues including the financing of healthcare, public health, preventive healthcare, chronic illness & disability, long- term care & mental health.
