SPD 510 DUE PROCESSCASE STUDY 2021/2022. Stephen is a student with autism that is currently placed in an inclusion classroom for most of his day (2018). He does not speak very much, but he communicates using picture cards (2018). He is exhibiting more attention-seeking behaviors such as biting, pinching and yelling (2018). The school is proposing a placement change, the parents are reluctant to remove him from a general education classroom. Steps That Need to be Taken The first step that I would recommend is getting more data on Stephen. This needs to be done at the same times every day as often as possible, preferably by the same person and throughout the entire day. There are several people who can collect this data including the general education teacher, special education teacher, a paraprofessional, an administrator, etc. Once this data is collected for a couple of weeks, I would review it and see if the data supports the thinking that Stephen would be better suited for a different placement. Some options to consider might be getting a paraprofessional to assist in the class with Stephen, giving Stephen more quality breaks with an adult or peers, having him in the resource room more, or other options. All of these options should be considered and reviewed by the IEP team before the meeting with the parent. That way everyone knows what is possible and what can be offered. If the best placement would be out of the general education classroom, then that needs to be discussed as well. Then I would set up a meeting with Stephen’s parents and the whole IEP team. At the meeting discuss what has been happening, show them the data, and explain the different options. It is very important to be very descriptive and specific with the parents and to ensure that they understand every part of the process. If after a third attempt, an agreement is still not made, it might be time to consider a due process hearing to get the student into the correct placement. The special education teacher will need to consult the principle and the special education program specialist to determine if this is the right step to take. If they agree that this is the right step to take, then the special education teacher needs to inform the parent that this is the next step. Letting the parent know this gives them an opportunity to resolve the problem before needing to file for a due process hearing. If a decision is not made after that meeting then it is time to file for a due process hearing. A due process complaint form will need to be provided to Stephen’s parents and the state educational agency through mail, fax, or email (2012). The department of education will assign a case number upon receiving the request and send both parties a notice of hearing that outlines how the process works, the name of the assigned judge, the hearing dates, and other pertinent information. The school must inform the parents about any free or low-cost legal services available near them. They must also give the parent a procedural safeguard notice.
