When collective bargaining talks come to an impasse, the deal may go to arbitration.
Arbitration is the use of an outside third party to investigate a dispute between an employer and a
union and impose a settlement (Dessler 2017). Decisions made by the arbitrator are binding and
final. Alterations cannot be made to the final decision.
In the case of the Archibald Firefighters verses the town of Archibald, when the talks
came to an impasse, the services of an arbitrator were requested. The arbitrator researched other
compensation programs offered by fire departments around southern Ontario. While Archibald
firefighters were demanding that they be compensated on the same level as a City of Toronto
Firefighter, research performed by the arbitrator revealed that the demands made by the
firefighters were in excess of market conditions.
When researching compensation, a benchmark city was chosen to compare compensation
packages. Kitchener, ON, Guelph, ON, Cambridge, ON, Milton, ON were all considered but the
City of Brantford in southern Ontario was deemed to be the best comparison to Archibald.
Brantford is a city of roughly 100,000 residents as mentioned in the census (The Canadian Press,
2017), and is in close proximity to the city of Hamilton and Toronto. The City of Brantford has
the same qualities as Archibald such as population, geographic location and environmental
concerns. Both are considered feeder cities to the City of Hamilton and Toronto.
Brantford Firefighters compensation does offer a 100% pay for firefighters injured on
duty, and they do make provisions for early retirement for firefighters. (SDC, 2016). The
demands by the Archibald Firefighters was fair and within market conditions. The salary
