Due to the fatality that was experienced at this facility prior to the inspection
from OSHA, there is the potential for some of the citations to be referred to the United
States Department of Justice. This document outlines the citations that could apply,
and how they will affect certain personnel of the company.
There are multiple citations that the Area Director from OSHA could recommend
criminal prosecution to the Regional Director and RSOL to be send to the Department of
Justice. The Department of Justice will determine based on the evidence provided by OSHA if
the citation will be criminally prosecuted. The potential violations include the following:
Citation 1 Item 10- Employees were exposed to electrical shock
hazards. Citation 1 Item 6- No established energy isolation program
Citation 2 Item 1- Lack exposure sampling for employees welding on lead
containing alloys.
Citation 2 Items 2a-2b - No training program or on lead exposure to
personnel for personnel welding on lead containing alloys.
Citation 2 Items 3a-3b – No written HAZCOM program, and no training on the program.
The conditions that have to be met for these potential violations to be referred for
criminal proceedings would have to be one of the following reasons:
It can’t be based on the general duty clause Section 5(a)(1)
The nature of the violation that resulted in the death was willful.
Evidence from the inspection clearly shows that the violation of the standard caused the
death of an employee. The evidence must clearly shoe that the violation of the standard
was either a contributing factor or the direct cause of the death to the employee.
