This paper seeks to discuss select employment and labor laws as well as economic issues
for a company seeking to broaden its base internationally. XYZ is a construction company
based in the United States which seeks to introduce its operations abroad. The labor laws in the
United States differ greatly with labor and employment laws elsewhere, so it is of essence for
XYZ Construction Company to get acclimatized to the situation in the country it seeks to set
base.
Trends in labor and employment laws in the United States will also be looked into, with a
detailed review into one of the important federal law areas. The paper will also look into the
economic issues that the company will have to look out for.
In the United States, employment and labor laws are adapted from local, state and federal
laws that vary depending on the jurisdiction of the specific employer. Employers are prohibited
from acting punitively against employees who exercise their rights under the employment and
labor laws. Whistleblowers are also protected when they raise complaints of violation of the said
laws. Each and every state has its own sets of laws that offer protection to employees in a nature
similar to, and sometimes to a nature greater than the federal law affords. While federal laws
rarely cover small employers, they are adequately covered by the state and local laws.
In the United States, most private sector employees have the right to organize trade
unions in their places of work. Employers are strongly prohibited from interfering with matters
concerning such trade unions. When an employee chooses a particular union to represent them,
the union is obliged to meet with the employer to reach a binding agreement which should be in
good faith, on the terms and conditions for the employment. Trade unions are allowed to take
industrial action, such as striking and picketing, as long as these are done in a lawful manner.
