LET XXX COMPANY LIMITED of Eldoret within the Republic of Kenya within 15 days
after service of these summons upon it enter an appearance to these summons which is issued
upon the application of Pentecostal Evangelical Fellowship of Africa Registered Trustees
who claim to be entitled to be declared as the proprietor of parcel of land registered as Land
Reference Number 6455/2 by virtue of Adverse possession for the period prescribed in the
Limitation of action Act Cap. 22 Laws of Kenya for the determination of the following
questions.
1. WHETHER the Applicant/Plaintiff is entitled to be declared the proprietor of parcel of
Land Reference Number 6455/2 by virtue of its Adverse Possession for the period
prescribed in the LIMITATION OF ACTIONS ACT CAP. 2 Laws of Kenya.
2. WHETHER the Registrar of Lands is to be directed that the Order made herein shall be an
instrument of transfer of ownership of Land Reference Number 6455/2 from the
Respondent to the Applicant.
3. WHETHER the Respondent can be restrained from entering, wasting, damaging and/or in
any way alienating Land Reference Number 6455/2 until the hearing and determination of
this matter.
4. WHETHER the costs are to be in the cause.
