"India's LGBTQ Laws-An Overview of Recent Legal
Developments”
Malvika Gupta

LGBTQ people have been the subject of discussion for many years. The basic tenet of the
government was the concept of securing this society through fairness, justice, and togetherness. The
abbreviation LGBT stands for lesbian. bisexual, homosexual, and transgender. Originally known as
the gay community, the LGBT has since expanded to encompass various categories of homosexuals.
This minority frequently faces discrimination, which renders them socially isolated, marginalised,
and deprived of their fundamental rights as Indian citizens.
Lesbian, gay, bisexual, transgender and Queer is referred to as LGBTQ. Although the term "gay"
currently solely applies to males, this community was formerly known as the homosexual
community. As a result, the group became known as the LGBT community in the middle of the
1980s.
Historically, the term "gay" has been used to describe persons who are drawn to other people of the
same sex. But often, the term "gay" refers to guys who have a sexual attraction to exclusively other
men. Lesbians are females who have a sexual attraction to exclusively other females. A bisexual
individual is someone who finds both men and women attractive. People who identify as
transgender do so in a way that differs from the gender they were given at birth. When transitioning
from one gender to another, some transgender persons ask for medical help.
The National Legal Services Authority v. Union of India case, according to the Supreme Court of
India, has changed the way transgender individuals are referred to as the "third gender." The
decision granted people the ability to identify as male, female, or a third gender and reaffirmed the
equitable application of the basic liberties protected by the Indian constitution.
The lesbian, gay, bisexual, and transgender (LGBT) population still suffers substantial social and
legal hurdles in India that are not faced by non-LGBT persons, despite the fact that LGBT rights
have advanced quickly since this judgement. doing. Laws against homosexuality were in place
during the colonial era. After India gained independence, Article 15 of the Indian Constitution
abolished it. Discrimination based on sexual orientation and gender identity is prohibited under
Article 15 of the Indian Constitution.
The LGBTQ community has encountered oppression in different forms from ancient India to the
twenty-first century.

Difficulties faced by LGBT in today's society
LGBT persons encounter a variety of difficulties in a culture where only heterosexuality is tolerated
and homosexuality is stigmatised. They deal with abuse on an almost regular basis as part of their
everyday routine. Because of their sexual orientation, they are more prone than heterosexuals to
encounter intolerance, prejudice, harassment, and threats of violence. confronting aggression. The
rights afforded by heterosexual couples are not available to same-sex couples in many nations. The
denial of certain rights. They experience prejudice as a result, and social safety programmes like
health care and pensions are not available to them.
LGBT individuals even conceal their gender and refuse to disclose it out of concern for their
employment. Low self-esteem eventually sets in for them. LGBT parents who behave entirely out
of worry and care will not be welcomed by parents of regular kids. Conflict between families is
frequently brought on by parents' lack of communication with their LGBT children.

, Many LGBT young people are transferred to foster care, juvenile correctional facilities, or the
streets. Because their parents and guardians rejected them, her LGBT teenagers are far more likely
to experience physical and mental health issues as adults. To cope with stress, some people turn to
drink or narcotics. Everyone is cut off from you. As a result, they experience hate crimes. In many
nations, homosexuality is viewed as a crime that is frequently sanctioned by penalties and
incarceration. It is also prohibited by several personal laws and is seen as a sin.

History
Hindu texts show that the third gender is accepted in Hinduism. Shikhandi, who is sometimes
supposed to have been born female but subsequently recognised as male and married to a woman, is
one such figure whose gender is said to have changed in various versions of the Maharashtra epic.
The Hijra's venerate the fertility goddess Bakhchara Mata as their patroness. His two primary
Sanskrit works on dharma and medicine, the Nradasmti and Sushruta Samhita, respectively, declare
homosexuality to be unchangeable and prevent homosexuals from getting married to people of the
opposite sex. However, homosexuality is subject to several punishments in the Hindu book
Manusmriti. Manus Murriti claimed that the sexual union of two people, gay and straight, in a
bullock cart was what caused homosexual men to lose their caste.
The existing set of regulations in his Sultanate in Delhi were summed up by Fatwa Airamgiri, who
established a uniform set of punishments against jina (illegal intercourse), including homosexuality,
during the Mughal dynasty. These may consist of his 50 lashes for a slave, his 100 lashes for a free
pagan, and his death by stoning for a Muslim.
The Indian Penal Code's Section 377 was imposed by the British administration during the colonial
era. Both homosexuality and bisexuality are forbidden under Article 377. Sexual activity with a
man, woman, or animal that violates the natural order is illegal and punished under IPC Section
377. There were no regulations governing sexual activity in India prior to the passage of this statute
in 1861.

Visibility and Exposure

spoke out about their sexual orientation and gender identity 59% of the time, and 39% thought that
LGBT people display affection in public. (such as a kiss or handshake). Lesbian, homosexual, and
bisexual athletes are publicly supported by 56% of sports teams, and more LGBT characters are

non-binary, non-conforming, or gender-biased family members, acquaintances, or coworkers.

• 2017
The International Lesbian, Gay, Bisexual, Trans and Intersex Association (ILGA) conducted a
survey in 2017 that found that 58% of Indians agreed that homosexuals, lesbians, and bisexuals
should have the same rights as heterosexuals and 30% disagreed. According to a survey, 59% of
respondents believe that people should be shielded from discrimination at work. According to a
survey, 44% of Indians disagree with the opinion held by 39% of them that gay couples should be
punished as criminals. Sixty-six percent of transgender persons believe they should have equal
rights, sixty-two percent believe they should be shielded from job discrimination, and sixty
percent want their legal gender to change. I believed that I ought to be able to utilise it.
