Question 1 Jim owns a bar in Bangsar. On a busy night Charles comes in with some friends for a few drinks. After three pints Charles drops his pint on the floor. Jim sends one of the barmen, Brendan, to wipe it up. It is a busy night, so Brendan only wipes up some of the beer and the floor remains quite wet. After several more pints, whilst going to the bar to buy another round, Charles slips on the wet floor and breaks his arm. Advise Charles whether he has a valid legal claim in suing Jim and whether there are any defences available to Jim by referring to relevant cases. Question 2: Adam, a keen Art collector decided to visit his favourite antique shop, called “Quantique” in Kuala Lumpur to look for a good bargain. Adam saw a beautiful and unique pot displayed prominently at the shop window with a price tag of RM5,000. Adam immediately fell in love with it. Adam went in to ask the shop owner, Charles, if he was willing to let Adam purchase it for RM3,500. Charles agreed to sell it for RM4,000 and as Adam requested for time to think about it over lunch, Charles agreed not to sell it before Adam returned. However, when Adam returned to buy the pot, Adam found that Charles had already sold it to Elle, who had paid RM4,500 for it. Advise Adam whether there is likely to be a contract between him and Charles by referring to the Contracts Act 1950 and relevant cases.
