There are several laws regarding employment practices that are aimed to protect employees
against discrimination based on race, color, sex, age, disability, pregnancy, and genetic
information. In the U.S. these are issued at the Federal and State level and enforced by the U.S.
Department of Labor and the U.S. Equal Employment Opportunity Commission (Kurt, 2022).
Similar laws are found in many countries to protect employees and create a safe working
environment free from discrimination.
However, the litigation cases regarding workplace issues that include employment
discrimination, unsafe working conditions, and wage-hour issues have been increasing at an
alarming rate (Franke et al. 2012). This might be taken as an indicator that many firms and
managers have not addressed these issues properly. Managers should be knowledgeable about
employment laws and practices and make sure it enforces them without discrimination.
To best equip managers to handle these issues they should be trained regularly and it would be
the responsibility of the human resource manager to facilitate that. One of the many laws
regarding employment is the Occupational Safety and Health Act of 1970. This act was passed to
reduce the dangers or risks happening in the workplace. The act provides many industry-specific
guidelines and safety provisions (Occupational Safety and Health Administration, n.d.).
Furthermore, it provides penalties to employers that violate this act willfully.
One of the industries that see many workplace injuries and accidents is the construction industry.
Contractors have the responsibility to implement the highest standards of safety in their
workplace and project managers have to supervise to make sure that they are implemented (MSC
Safety Solutions, 2021). In some cases, safety managers are assigned for this specific reason.
Based on my experience training project managers to prioritize safety is a difficult task. In many
projects time, cost, and quality of the work are given priority rather than safety.
The training is given to project managers, construction managers, and safety managers first.
