(42-1-102) (17.5) COMMERICAL VEHICLE A vehicle used to transport cargo or passengers for profit, hire, or otherwise to further the purposes of a business or commercial enterprise. (42-1-102) (68) PEDESTRIAN any person afoot or any person using a wheelchair (42-1-102) (81) RESIDENT any person who owns or operates any business in this state or any person who has resided within this state continuously for a period of ninety days or has obtained gainful employment within this state, whichever shall occur first. (42-1-102) (85) ROADWAY that portion of a highway improved, designed, or ordinarily used for vehicular travel, excluding: the sidewalk, berm, or shoulder (42-1-102) (88) SCHOOL BUS a motor vehicle that is designed and used specifically for the transportation of school children to or from a public or private school or a school-related activity, whether the activity occurs within or without the territorial limits of any district and whether or not the activity occurs during school hours 42-2-101 Licenses for Drivers Required No person shall drive any motor vehicle upon a highway in this state unless such person has been issued a currently valid driver's or minor driver's license or an instruction permit 42-2-115 License, permit, or ID on demand No person who has been issued a driver's license who operates a motor vehicle shall refuse to hand their license to a peace officer (Regarding a violation of articles 2, 3, 4, 5, 6, 7, or 8) (42-2-119) How long does a person have to provide notice of a new address on a driver's license? A person shall, within 30 days provide notice of the new address. 42-2-136 Unlawful possession or use of license No person shall have in such person's possession a lawfully issued driver's license that is: Falsely altered Fraudulently Obtained Falsely appears to be lawful Issued to another person No person should refuse to surrender their license to the department upon lawful demand 42-2-202 Habitual Offenders - frequency and type of violations 3 or more convictions within 7 years for: DUI, DUI per se, DWAI, Reckless, false affidavit, vehicular assault/homicide/manslaughter or criminally negligent homicide 10 or more convictions within 5 years for: Points assessed (4 or more), (3 or less - equaling 18 or more convictions) 42-2-206 Driving after revocation prohibited (DARP) It is unlawful for any person to operate any motor vehicle in this state while the revocation of the department prohibiting the operation remains in effect 42-2-138 Driving Under Restraint (DUR) Any person who drives a motor vehicle or off-highway vehicle upon any highway of this state with knowledge that the person's license or privilege to drive, either as a resident or a nonresident, is under restraint for any reason other than conviction of DUI, DUI per se, DWAI, or UDD is guilty of a class A traffic infraction. 42-2-309 Unlawful Acts It is unlawful for any person to: Display a fictitious or falsely altered ID card To alter, reproduce, distribute, resale, or reuse To lend Use another's issued card (42-2-402) COMMERICAL MOTOR VEHICLE A motor vehicle designed or used to transport passengers or property, if the vehicle: has a vehicle weight rating of 26,001 or more LBS is designed to transport 16 or more passengers including the driver is transporting hazardous materials and requires a placard (42-2-404) What are the limitations of obtaining a commercial driver's license?
