• How can you precisely describe real estate so
that it can be properly conveyed,
encumbered and contracted for?
– The general rule for legal description in Texas is the
nucleus of description theory
– To comply with the Statutes of Conveyance and the
Statute of Frauds:
• “the writing must furnish within itself, or by reference to some
other existing writing, the means or data by which the
particular land to be conveyed may be identified with
reasonable certainty.”
