Controlling Interest
an officer, director, or person with 5%+ ownership interest in a facility or management company that
operates a facility
Facility
any entity providing nursing, custodial, or personal care exceeding 24 hours for 3+ person (not related
to the owner or manager by blood or marriage) and require nursing services due to illness, physical
infirmity, or advanced age
Nursing Home Bed
an accommodation (including necessary equipment and furnishings) immediately available or can be
ready for occupancy within 48 hours
Nursing Home Facility
any facility which provides nursing services
Voluntary Board Member
a director of a not-for-profit corporation or organization serving in a voluntary capacity and does not
receive any remuneration
Responsibility of Licensee
- the licensee (owner, corporate body) has full legal responsibility for the operation of the facility
- must hire a licensed administrator to manage day-to-day operation of a facility
- facility must be organized according to a written table of organization
Vacant bed report must be submitted to
AHCA monthly
Nursing home staffing report must be submitted to
AHCA quarterly
,Quality of Long Term Care Improvement Fund
supports activities and programs directly related to improving resident care (dementia training)
Level 2 Background Screening
1) involves FBI fingerprint check
2) fingerprints collected electronically and submitted to Florida Department of Law Enforcement
(FDLE)
3) FDLE submits fingerprints to FBI
Who must have a Level 2 screening
1) licensee, if an individual
2) administrator
3) financial officer
4) any person with a controlling interest, if agency has reason to believe
5) any employee or contractor who will provide personal care or services directly to residents or have
access to resident funds, personal property, or living areas
Disqualifying Offenses/Convictions
1) murder/homocide
2) assault or batter on elderly/child
3) domestic violence
4) theft or robbery
5) MCD provider fraud
6) MCD fraud
7) fraud in obtaining medicinal drugs
8) kidnapping or false imprisonment
9) sexual misconduct
10) prostitution or indecent exposure
11) arson
12) fraudulent insurance claims
Conditional Work Status
an individual may start work before their background results are finalized but can't have contact with
residents
Re-screening
each employee must be rescreened every 5 years
General ledgers and disbursement journals must be brought current no less than
quarterly
Resident Bill of Rights
must be given at time of admission, as changes are made, and upon request
Facility's admission and discharge policies
must be given at time of admission, as changes are made, and upon request
, Information regarding advanced directives
must be given at time of admission, as changes are made, and upon request
Resident Services Contract
- each resident must have a contract detailing services and charges, refund and bedhold policies
- retain for 5 years
- need a new contract if payor source changes
- give 14 days advance notice of any changes
Resident personal property policy
- must be provided to every employee
- each resident within 30 days of admission
Deceased resident funds and property
- must refund all funds and provide final accounting within 30 days of death
- if no spouse or next of kin, must deposit in interest-bearing acct until disbursed by probate court
- if not disbursed by probate court within 2 years, must deposit in resident protection trust fund
- must keep deceased's property and funds separate from other residents'
Deceased resident funds - bank acct
1) Maintain one account for all deceased residents whose funds total less than $100
- allocate interest to each individual acct
2) Maintain a separate acct for each deceased resident with more than $100
RTF Surety Bond
- must equal 2x average monthly balance during prior fiscal year or $5,000 - whichever is greater
- licensee with more than 1 facility can purchase a single surety bond to cover all homes in same
AHCA service district
- surety must notify AHCA 30 days in advance if facility cancels bond
RTF Self-insurance pool
- facility may self-insure instead of surety bond
1) pool together with other facilities to establish interest bearing account administered by an elected
board of trustees
2) board of trustees must be composed of 1 rep from each participating facility
3) each member must deposit greater of 2x monthly average or $5k in an acct maintained by board of
trustees in the name of the self-insurance pool in a chartered commercial bank in FL
4) compensates any resident suffering financial loss as the result of misconduct by on or more of the
member licensees
If no surety bond or self-insurance pool
if resident requests facility hold funds, facility must notify AHCA, in writing, of the request and apply
for a surety bond or participation in self-insurance pool within 7 business days
facility policies
- must have policies and procedures governing all services provided in the facility
- P&P must be reviewed at least annually
- must be reviewed by administrator, medical director, and DON
