What are the problems created by the application of the doctrine of
Terra Nullius within the medieval conquered territories and in the
context of colonial conquest?

,1. Introduction

Terra Nullius is a concept that means "land belongs to no one." It has been used in many ways
throughout history, from medieval conquests to colonial subjugations, which has led to many
problems and disagreements. This basic law idea for European colonization sped up the unfair
taking over of other countries, which caused many native groups to move, their cultural identities
to be lost, resources to be exploited, and many other negative effects on the economy, society, and
the environment. The point of this discussion is to look at the different problems and effects of
using Terra Nullius during both the medieval and colonial periods of territorial dominance.

1.1. Definition of Terra Nullius

The Latin term "Terra Nullius," which translates to "land belonging to no one," signifies a legally
significant principle of historical importance. Essentially, it allowed colonizing nations to seize
and incorporate regions without acknowledging the inherent rights or claims of the Indigenous
communities living there. According to this idea, if a place seemed uninhabited or did not have
European-style farming and social systems, it was considered "vacant" and so available for
colonization.1 This contentious principle acted as a fundamental basis for the growth of colonial
empires and the validation of their geographical conquests. An in-depth analysis of the origin and
historical circumstances surrounding Terra Nullius is essential for understanding the intricate
inequities and difficulties that arose as a result of its implementation.

1.2. Historical background of the doctrine

The intellectual foundation of the Terra Nullius doctrine can be traced to the jurisprudential
concept of "res nullius" within Roman law, denoting things or resources devoid of ownership until
claimed through possession or occupation.2 This notion was embraced and amplified by European
explorers and colonial powers during the Age of Discovery. 3 To legitimize their expansionist
campaigns, legal theorists and philosophers of the era formulated the Terra Nullius principle,

1.3. Medieval Conquered Territories
The term "medieval conquered territories" refers to lands subjected to military defeat and
subsequent colonization during the Middle Ages.5 These conquests often led to the subjugation of
native populations by emerging states or empires, resulting in the displacement, marginalization,
and exploitation of the conquered societies.6 The application of the Terra Nullius doctrine in these
regions further exacerbated the plight of indigenous communities. Their inherent rights, traditional
ways of life, and established forms of governance were disregarded and supplanted by the
dominant colonial powers.7

1.4. Colonial Conquest

The term 'Colonial conquest' refers to the measures adopted by foreign powers to establish and
preserve control over distant territories.8 This is especially relevant to historical periods where
European countries sought to extend their political influence and capitalize on resources in areas
beyond their own territories. The application of the Terra Nullius doctrine during colonial conquest
furnished these powers with a justification for seizing and exploiting indigenous lands, often
resulting in the dispossession, suppression, and domination of indigenous societies. 9 The
repercussions of these colonial expeditions remain deeply embedded within present-day societies
