Lesson 1; Constitutional Law Pt.1
The criminal justice system is guided by three branches of government which are the:
Legislative, Executive and Judicial.
The Legislative branch is made up of The House of Representatives and Senate. These
two groups make up the United States congress. Congress develops ideas for laws which
are referred to as "bills" in their early stages. The bills are reviewed and voted on, and if
a favourable majority vote (51 of 100 in favour) is received the bill is then passed on to
the executive branch.
The Executive branch is made up of The President, his advisors and various federal
agencies. The president then has ten days to veto or sign the bill into law.
The Judicial branch is composed of the United States Supreme Court. The supreme
Court consists of one chief justice and eight associate justices. These justices are
nominated by the president and approved by the senate. The United States Supreme
Court is the highest court in the country.The constitution of the United States gives the
Supreme Court the power to review the actions of the President and Congress.The most
important duties of the Supreme Court is reviewing cases that have already been
adjudicated in lower state and federal district courts. These cases are brought before the
Supreme Court for review. Appeals found have merit are then heard by the Justices -
Cases are then overturned or upheld based on their adherence to constitutional law. The
entire law enforcement community is required to adhere to and adjust policies based on
the laws developed by the Legislative branch and passed by the executive branch. The
Supreme Court is then responsible for assuring these laws are applied in a constitutional
manner.
