Two major types of Title VII Cases - ANSWER: Disparate Treatment
Disparate Impact
Disparate treatment - ANSWER: lawsuit in which plaintiff asserts that because of a
factor he or she has been treated less favorably than other within the organization
To win a disparate treatment case - ANSWER: plaintiff must show that the company
intended to discriminate because of one of the factors the law forbids
Two types of disparate treatment cases - ANSWER: pattern-practice cases
reprisal or retaliation cases
Pattern-practice cases - ANSWER: case in which the employee asserts that the
employer systematically discriminates
Reprisal or retaliation case - ANSWER: case in which employee must show that the
employer discriminated against him or her because that employee asserted their
rights
Disparate impact case - ANSWER: show that although the employer may not have
meant to discriminate but the effect or impact of an action was discriminatory
Title VII definition of relgion - ANSWER: including religious observances and practices
as well as belief and requires employer to reasonably accommodate to an
employee's religious observances
