Under the Social Media Accountability Act 2023, a social media regulatory commission (“the
Commission”) is established with the remit to provide regulation and approval for all individuals and
organisations with more than 5,000 social media followers to undergo a background check and obtain a
licence from the government before being allowed to post any content on their platforms. Under the
statute the Commission has the following powers:
s.9 The Commission has the power to create any regulations required to fulfil its statutory duties.
s.16 The Commission should approve any application from a candidate standing for elected office.
s.45 Any regulations issued by the Commission are final.
The followine events hapen:
E. Emmanuel runs a small grocery business and holds a social media licence from the Commission for
several months. Suddenly, he receives a letter saying that his social media licence has been revoked as he
wrote a post about the differences between apples and pineapples. The Commission say this was a
waste of time and use of social media
Advise Emmanuel on any grounds for Judicial Review.
