1. Police have the primary responsibility for detecting and investigating crime to
include gathering evidence, arresting suspects, testifying in court. They do not have
unlimited powers to do these actions. Discuss the rules of evidence. What limitation
on power does the fourth amendment give to the citizens of the United States? What
are some the exceptions to the exclusionary rule?
Any evidence related to the case and acquired legally is regarded as permissible (Born &
Rutledge, 2022). The Fourth Amendment in U.S. Constitution defends citizens from
unconstitutional searches as well as seizures. According to the exclusionary rule illegally
obtained evidence is inadmissible in court unless certain exceptions apply, such as clerical error,
good faith, inevitable discovery, or independent source (Priester, 2019).
2. What is search incident to lawful arrest? What is needed in order for an officer to
search you after you are arrested?
Police conduct a warrantless search to apprehended individual plus the area around to
protect themselves and preserve any evidence for trial as authorized by the Chimel rule (Jenkins,
2017). The search must be geographically relevant to the arrest and must not include the
arrestee's home or car. This search is legal as long as the arrest is authorized and is often
acceptable in court.
3. Discuss public safety exceptions when searching without a warrant?
Law enforcers can search without a court order if they gain authorization from a person
with a rational expectation of confidentiality in the searching area (Priester, 2019). This is
advantageous for police since it does not need a warrant, probable cause, or reasonable
suspicion. Furthermore, if the cops are legally present, they may collect evidence in plain sight
